Supreme Court Orders Equal Pension, Irrespective of Joining Date

The Supreme Court has recently taken up the issue of low pensions being given to some retired High Court judges. As part of this, the Central Government has issued orders to provide full and equal pension to all former High Court judges. However, it has been revealed that all judges should be given pension regardless of the date of joining the job and other matters. The Supreme Court has given a sensational verdict clarifying that the benefits after retirement should be equal for the National Green Tribunal judges and all district judges.


Supreme Court Orders Equal Pension

The Supreme Court has recently given a verdict that has firmly established the principle that equality in the judicial system should not be in words. It should be seen in the laws. It has issued orders to give equal pension to all judges of all High Courts. Chief Justice of India Justice BR Gavai expressed his opinion, saying that the benefits after retirement should be the same as the salaries of judges to protect the independence and dignity of the judicial system. It was stated that no distinction should be made between permanent and additional judges under any circumstances.

He explained that benefits like gratuity and family pension to other dependent family members, including widows, should also be provided to all judges in the same manner. The CJI said that any discrimination between judges after retirement for terminal benefits would be a violation of Article 14. Therefore, all High Court judges are entitled to full pension, irrespective of when they joined.


Rs. 15 lakhs for former CJIs and Rs. 13.5 lakhs for retired High Court judges

A Supreme Court bench headed by Chief Justice Gavai has directed the central government to henceforth pay a pension of Rs. 15 lakh per year to former Chief Justices of all High Courts and a full pension of Rs. 13.5 lakh to retired High Court judges.
