Rhea Chakraborty gets BIG relief as Supreme Court dismisses CBI’s plea to reinstate lookout notice against her in Sushant Singh Rajput Case. The CBI issued a lookout circular against actress Rhea Chakraborty following the death of actor Sushant Singh Rajput.
The Supreme Court rejected a petition from the Central Bureau of Investigation (CBI), Maharashtra state, and the Bureau of Immigration on Friday (October 25, 2024), challenging the Bombay High Court’s decision to nullify the look-out circulars (LOCs) issued against her, her brother Showik, and her father, Lt Col Indrajit Chakraborty (retd), in connection with the Sushant Singh Rajput death case.
According to Live Law, a bench of Justices BR Gavai and KV Viswanathan orally stated that the plea was “frivolous” and was submitted solely because the defendants were “high-profile”.
Justice Gavai allegedly told the CBI counsel that they had filed a frivolous case only because one of the accused was a prominent figure. When the attorney asked for a pass on the subject, he warned that the petition could result in an exorbitant expense, underlining that both individuals had deep societal links.
Justice Gavai stated that if the CBI sought costs along with some “compliments,” a pass-over would be granted. Earlier in February, the Bombay High Court struck down the CBI’s LOC issued in 2020 against Rhea Chakraborty and two of her family members in connection with Sushant Singh Rajput’s death.
A court of Justices Revati Mohite Dere and Manjusha Deshpande gave approval to the petitions brought by Rhea Chakraborty, her brother, and their father contesting the LOCs that limited their overseas travel. An LOC given by an investigative agency allows the Bureau of Immigration to hold an individual, prevent them from boarding a flight, or notify the appropriate agency if the subject attempts to leave the country.
The high court removed the LOC after a vacation bench suspended it in December, allowing Rhea Chakraborty to attend a meet-and-greet event in Dubai despite the CBI’s vehement objections. In previous hearings, the court questioned the justification for granting LOCs simply based on an FIR lodged against the actress.
Jurisdiction became a subject of contention, as Sushant Singh Rajput’s family filed the initial FIR in Patna before the CBI took over in Delhi. Rhea Chakraborty’s legal team argued for Mumbai’s jurisdiction, citing that both parties lived there and the inquiry was performed locally.
The bench expressed worry that the case has been open since 2020 without a charge sheet from the CBI, emphasizing the significance of quick settlement in judicial affairs.
The court also questioned the reasons for awarding LOCs, with Chakraborty’s attorneys arguing that a LOC should only be imposed if there was strong evidence that the accused was intentionally avoiding arrest or court appearances.
