Shah Bano’s Daughter Moves HC Against Film ‘Haq’

Haq Movie in Trouble: In the Madhya Pradesh High Court, the daughter of Shah Bano Begum, the Indore woman who bravely battled for alimony from her ex-husband, has petitioned for a stay on the release of the Hindi film “Haq” on the grounds that it misrepresents events from her mother’s private life.


The Suparn S. Varma-directed movie, which opens in theaters on Friday, November 7, is reportedly based on the Shah Bano case, which led to a historic Supreme Court ruling on maintenance for Muslim women after a divorce in 1985. The main performers in the movie are Yami Gautam Dhar and Emraan Hashmi. Siddiqua Begum Khan, the daughter of Shah Bano Begum, filed a plea in the Indore bench of the High Court, arguing that the film was filmed without the approval of her family and that it misrepresents events from her late mother’s private life.

Tousif Warsi, Khan’s attorney, told the media that the plaintiff and defendant’s attorneys showed up in court on Monday, the same day that his client’s case was listed in the HC for the first time. Following a quick hearing, the court scheduled the next appearance on Tuesday, November 4, according to Warsi. An Indore resident was Shah Bano. After her lawyer-husband, Mohammad Ahmed Khan, divorced her in 1978, she sued him in a local court to get maintenance.

In 1985, following a protracted legal struggle, the Supreme Court decided in her favor. The Supreme Court’s five-judge Constitution bench decided that Muslim women had a legal right to maintenance as well. The Muslim Women (Protection of Rights on Divorce) Act was passed in 1986 by the then-Rajiv Gandhi government in response to demonstrations by Muslim organizations. The Supreme Court’s ruling in the Shah Bano case was overturned by this law. In 1992, Shah Bano passed away.
