The battle for the courts is on with the Supreme Court beginning to hear a writ petition on behalf of the state of Andhra Pradesh. It says that granted additional terms of reference (FTOR) for the Krishna Water Disputes Tribunal-II (KWDT-II).
Andhra Pradesh to FTOR for KWDT-11
Andhra Pradesh approached the Supreme Court on October 17, 2023. With a written petition asking the Supreme Court to set aside the recent notification. And suspend all proceedings of the KWDT-II under the FTORs. The FTORs were issued by Telangana in 2014 upon receiving a Section-3 complaint under the Inter-State River Water Disputes (ISRWD) Act, 1956. The complaint was for equitable sharing of Krishna river waters between Telangana and Andhra Pradesh. Now that the case is before the judiciary, with Andhra Pradesh accusing the FTORs. This impacts on its rights to water adversely and being detrimental to the state’s interests.
During Wednesday’s hearing which began, the Supreme Court gave a hearing to the details of Andhra Pradesh’s grievance. The state contends that the issuance of the FTORs ignoring its stand or by way of any sort of negotiation undermines the regime established under the ISRWD Act. In requesting the quashing of the notification, Andhra Pradesh seeks to delay the KWDT-II proceedings. Until they start a fairer adjudication procedure is . But the Supreme Court has denied an immediate stay, instead ordering Andhra Pradesh to cooperate fully with the tribunal hearing while they consider the case.
Implications for the water dispute process
