Waqf Amendment Act:
YSR Congress Party has filed a petition in the Supreme Court.It has challenged recent amendments to the Waqf Act made by Parliament. The party stated that the new law includes serious constitutional violations and fails to address the concerns of the Muslim community. Senior advocate Mahfuz Ahsan Nazki submitted the petition on behalf of the party.
YCP stated in the petition that the amended Waqf Act promotes discrimination among religion.The party argued that it violates Articles 14 and 15 of the Indian Constitution. These articles guarantee equality and prohibit discrimination. YCP urged the Supreme Court to declare the amendments unconstitutional.
Muslim Representation Removed
The party highlighted that the amendment removes the mandatory condition of having a Muslim CEO for the Waqf Board. The inclusion of non Muslims in Central Waqf Council and state boards is also seen as a violation of the core principles of Waqf. YCP argued this change undermines rights held by the Muslim community for generations.
Government Interference in Religious Matters
YCP pointed out that the new law gives excessive powers to authorities over Waqf properties. It allows intervention in religious affairs and control over property management. This,the party said, goes against the spirit of the original 1995 Waqf Act. The petition noted that the government now has the power to declare any Waqf property as public land, erasing previous protections.
Violation of Constitutional Articles
The petition claimed that the amended Act violates Articles 13, 14, 25 and 26. These provisions deal with fundamental rights, religious freedom and the right of communities to manage their religious affairs. YCP argued that the law threatens the autonomy of Muslim religious institutions.
New Law Disregards Islamic Practices
The petition stated that the Waqf system is based on Islamic law and traditions. By allowing non Muslim interference, the amendment disrupts the religious nature and management of Waqf properties. YCP requested the Supreme Court to strike down the new law to protect religious rights.
