It acquitted the boyfriend, stating that an extramarital affair does not constitute a crime. The court also noted that the outdated Mahabharata ideology, which views a wife as her husband’s property, is no longer relevant.

It acquitted the woman’s boyfriend and stated that extramarital affairs are not considered a crime.
The court that conducted the hearing in this case issued a notice to her boyfriend, saying that it is wrong to continue an extramarital affair with a married woman. While the husband felt happy with this, the boyfriend challenged the judgement of the sessions court in the Delhi High Court, saying that he was being treated unfairly. Justice Neena Bansal Krishna, who conducted the hearing in this case, said that the consequences of a husband treating his wife as his property can be disastrous. He said that we can clearly understand this through the Draupadi episode in the Mahabharata. He said that the era of the Mahabharata era ideology of considering a woman as property based on this is over.
Justice Neena Bansal Krishna recalled the Supreme Court’s previous ruling that the definition of adultery under Section 497 of the IPC as a crime is unconstitutional. On this occasion, she quoted the Supreme Court’s comment that adultery is a matter of morality and should not be made a crime. The complaint filed by the woman’s husband was dismissed. The woman’s husband expressed his deep anger over this. He said that it is outrageous that a wife who is having an extramarital affair with her boyfriend while he is present does not have the opportunity to take action against her boyfriend.
