Ashoka Professor Case: While hearing Ashoka University professor Ali Khan Mahmudabad’s plea against his arrest over a social media post on Operation Sindoor, the Supreme Court declared today that ‘monsters’ had attacked the nation. The court questioned the professor on why he chose to seek ‘cheap publicity’ through his post.
The bench strongly criticized the comments shared on social media and warned the professor against making statements about the terrorist attack in Pahalgam.
Authorities arrested Professor Mahmudabad, the head of Ashoka University’s political science department, last week. He faces charges for allegedly promoting enmity between groups and making statements that could threaten the sovereignty and integrity of India.
Court Arguments:
To plead Mr. Mahmudabad’s case, Senior Advocate Kapil Sibal appeared before the bench of Justices Surya Kant and N Kotiswar Singh. In this case arguments Justice Kant said, “Yes, everyone has the right to free speech and expression … Is it the time to talk about all of this? Country is already going through all this… monsters came and attacked our people… we have to be united. Why to get cheap popularity on these occasions?”
In the response to it Mr. Sibal said, “where is the “criminal intent” in the professor’s social media post. Justice Kant replied, “You should know what is happening. There is a right to free speech etc… where is the duty. As if the whole country for last 75 years is only distributing rights and no duty.”

Sc grants interim bail:
While granting interim bail in the case, the top court ordered the professor to surrender his passport. During the hearing, the court posed several pointed questions, notably asking, ‘Why seek cheap publicity?’ The judges emphasized the need for a sense of responsibility, stating this was not the time for such remarks. Although the professor secured temporary relief, the case remains open as hearings will continue. Sources reveal the interim bail was granted considering his wife is nine months pregnant.
