H-1B Visa: Who’s Exempt from the $100,000 Fee?

H-1B Visa: Who’s Exempt from the $100,000 Fee?

H-1B Visa Exemptions: The United States Citizenship and Immigration Services (USCIS) has clarified that recent international college graduates who are sponsored for H-1B status while in the US will not be subject to a hefty $100,000 fee imposed on the program by the Donald Trump administration last month. This is seen as a huge relief for current US visa holders, including Indians.

Employers and visa holders are perplexed by Team Trump’s contentious presidential announcement on September 19, 2025, regarding the $100,000 H-1B visa cost, as prior US agency guidelines left many things unanswered.

What are the changes in H-1B Visa Fees?

1. A “change of status,” a situation in which an individual switches from one category to another without leaving the country, such as an F-1 student switching to H-1B status, or requesting an extension of stay within the United States, would not be subject to the high price.

2. The charge will apply to petitions filed on behalf of employees who are not in the US or who must depart the country before their petition is decided.

3. According to the reports, current H-1B visa holders will not be stopped from entering or leaving America.
